Who is your Medical Review Officer (MRO) and are you compliant with DOT rule, 49 CFR Part 40?

 

A Medical Review Officer (MRO) is a physician who is responsible for receiving and reviewing laboratory results generated by a company’s drug testing program. To ensure compliance, your MRO must be familiar with the regulations under the statute. The rule applies to any driver with a commercial driver’s license operating a vehicle under any of the following conditions;

  • Operating vehicle over 26,001 pounds
  • Transporting 16 or more passengers (including driver)
  • Transporting Hazardous Materials

Random Testing

  • 10% alcohol testing/yr
  • 50% drug testing/yr

Drug and Alcohol Testing Procedures

Alcohol testing must be performed by a trained, certified Breath Alcohol Technician (BAT) using an evidential breathing machine meeting the standards established by the National Highway Safety Administration.

Urine collection for druge testing is performed by technicians trained according to Federal DOT Urine Specimen Collection Procedures Guidelines, Regulation 49 CFR (C) 40.33. 

Employer Responsibilities

  • Every employer must retain records in accordance with DOT regulations.
  • The employer must provide employees with a written drug and alcohol policy.
  • Supervisors responsible for drivers under the program must complete a one hour training class.
